This winter the draft law on partnerships will be considered

Prime Minister Donald Tusk reported that on Wednesday he had an interview with the Minister of Equality, Katarzyna Kotula, who is ready to present a draft law on partnerships.

Donald Tusk assured that work on the task would be carried out in the coming weeks. This winter, regardless of whether it is submitted by a group of Members or by the government, will be the consequence of a partnership project.

ETPC accuses Poland

In early December, the European Court of Human Rights (ECHR) found Poland guilty of violating the right to respect for private life due to the deficiency of a legal framework to recognise and defend single-sex unions. ETPC received complaints from 5 Polish couples from Łódź, Krakow and Warsaw, who were refused matrimony by local authorities, arguing that Polish law only allows for the union of men and women. Their cases in the national court were rejected. The couple stated that they felt harmed by the deficiency of authoritative designation of their relationship, specified as in tax, social rights or household rights. The ETPC acknowledged them right.

What is simply a partnership?

In many European Union countries, couples have the chance to legalise their relation without having to marry, that is, through a partnership. In that case, 2 persons who live together and operate a common household may registry their relation with the applicable office or country of residence.

A partnership is simply a relation between 2 people, regardless of gender, who live together and live a shared home life but are not married.

In the case of registered partnerships, the scope of the rights and obligations of the parties may vary significantly: in any countries, partnerships have all or almost all rights and obligations of civilian marriages, while in others only any of them.
