Is the average without a grade in religion unconstitutional?

At the end of May this year, the Constitutional Tribunal issued a ruling stating that not including the grade from religion lessons in the average grade is unconstitutional due to the issuance of a regulation on this substance "without agreement and agreement with the authorities of the Catholic Church". However, this agreement is not needed at all, which was besides ruled by the Constitutional Tribunal respective years ago.
