Sending people to the border despite a request for asylum? This has been the case in Germany for about 2 months. The courts are doing this now.


The German courts are presently considering at least 3 lawsuits concerning the return of asylum seekers at the German border. It was informed by the Ministry of the Interior.

Courts in 3 cities involved


According to information from the local administrative court in Aachen, the suit was filed by a Turkish citizen who came from Belgium and was inspected at the main station in Aachen. The police sent him back to the Belgian border. A man presently lives there, but has an address in Germany. However, the court in Aachen inactive needs to find which jurisdiction will deal with the case.

The administrative court in Karlsruhe shall deal urgently and in the main proceedings with Algerian action. Police have already revoked their first refusal to enter due to the fact that a man entered the country and lives in a exile facility in Heidelberg. Therefore, the urgent procedure can be mostly terminated. However, the main proceedings are to take place.

The administrative court in Munich besides received an urgent complaint about Ukraine, which wanted to enter Germany via Austria and was likely to be returned.

In this case, too, the police withdrew their refusal to enter. It is not yet clear what this means for complaints. The Munich national Police Directorate reported that "for the protection of individual data does not supply any information".

The decision in Berlin sparked a stir


In early June, the Berlin Administrative Court's urgent decision triggered a public debate. The Court held that the refusal to enter the 3 Somalis during border control at Frankfurt Oder station was unlawful. Home Secretary Alexander Dobrindt spoke of "a ruling on an individual case" after the announcement of the decision. His ministry stated that the return of asylum seekers at land borders would continue.
