The consumer paid off a debt with an interest rate of more than 3000 percent per year for 19 years, as the regional court did not examine the content of the contract before issuing the order for payment. The ultimate Court judgement of 4 December 2025 recalls the fundamental principle: protection against unfair agreement cannot be the sole burden of the consumer – courts have a constitutional work to control the abuzzability of the clauses of their own motion, even if the organization does not ask for it.
