Andrzej Duda signed 2 key laws, which introduce crucial changes to the Polish labour market. The fresh rules concern both the employment of foreigners and the improvement of labour marketplace institutions. What precisely will change?
End of the labour marketplace test – fresh rules for employing foreigners
One of the laws signed – Act on the conditions of admissibility of entrusting work to foreigners – aims to reduce fraud, streamline procedures and full electronicise the authorisation process.
What's changing?
- Abolishing the labour marketplace test – so far, the employer has to prove that there is no anticipation of hiring a Polish or an EU associate to the job. Now it will be the region labour offices to decide in which industries and professions foreigners can be employed.
- List of professions reserved for Poles – The old man will be able to specify professions where there will be no permits for foreigners if the situation on the local labour marketplace deteriorates significantly.
- Stricter penalties for illegal employment – fine from 3 to 50 1000 PLN For all illegal employment of a foreigner.
- Strengthening control – The Border defender and the State Labour Inspection will be able to carry out checks without announcement and even operate in parallel.
Revolution in labour offices – fresh support for the unemployed
Second Act – Labour marketplace Act – replaces the provisions in force for 20 years. Modernisation is intended to improve assistance for the unemployed and make the offices more flexible.
Key changes:
- End of allowance 80% – people with a shorter work placement (less than 5 years) will no longer receive an allowance of 80% of the basic rate.
- Freedom to choose an office of employment – the unemployed will no longer be attached to the office according to the report. They will be able to registry with any region labour office.
- Priority for families of large and single parents – people with the household Charter and single children will be given precedence in accessing support.
- New support for young people – persons to 30 years old they will pass the evaluation of digital skills and will be a youth advisor at each employment office.
- Educational debt up to 400 % of average remuneration – funds can be allocated to training, postgraduate studies or confirmation of qualifications. Part of the debt (20%) can be decommissioned.
Summary: What do these changes mean?
New rules have improve the employment of foreigners, reduce illegal work and modernise assistance for the unemployed. Will the improvement deliver the expected results? Time will tell.
