The Wyborcza paper replied that, of course, yes, due to the fact that the president is only a "notary". But the answer is different – he didn't have to! There are many notaries, 1 can choose one, but – as far as I know – the president is only one. If the only specified “notary” would not want to call Żurek, who, and how could he force him to do so? So, of course, the president could have stopped at the cancellation of Bodnar. As for Żurek – he could refuse his appointment in front of the cameras and Tusk, in front of the full Poland, deservedly humiliate him.
Such action would definitely be a way out of the constitutional strategy and, to be fair, would require a blade of courage. However, after Tusk impertinently dismissed from acting as legal prosecutor in Poland – destabilizing the full strategy of law enforcement in Poland – the situation in our country is not in any constitutional strategy today. Tusk has committed an apparent crime in this way, which continues, and its effects affect the legal situation of tens of thousands of citizens. So it is adequate for the president to set Tusk a simple condition: I will appoint Żurek immediately erstwhile you reconstruct the regulation of law, allowing him to fulfil his duties as legal national prosecutor.
I even leave out that on the day of his appointment, Żurek became a justice and prosecutor at the same time, which is in no way compatible with either the Constitution or common sense. Yet, all notary has a legal work to refuse to execute an act contrary to legal order.
Instead of a pire around changes in government, Tusk would have a severe image and structural crisis of the government. The President, as guardian of the Constitution, would act as a defender of the fundamental rights and freedoms of citizens guaranteed by the Basic Act. due to the fact that they cannot be effectively protected in a country where the prosecutor – the body liable for safety and legal order – is led by an illegal usurper.
What could Tusk do to the president? Apart from threatening mines and aggressive rhetoric – nothing. In colloquially, he could kiss his proverbial nose. specified a spectacle would rapidly turn into a demonstration of Tusk's weakness and full political helplessness.
Tusk is simply a personality with a psychopathic streak. He's the kind who understands the language of strength. And this is about decisive action, not sharp, but empty words.
Unfortunately, the president at the end of the office did not surprise us positively and did not decide to make specified a move. Celebrating the celebration of changes in the government, he even thanked the members of the government – and so, o horror, besides Bodnar!
In consequence to this, Tusk, in the presence of the President, gave a political laity in the Palace, aimed straight at Andrzej Duda with an effort to ridicule the constitutional function of the president of Poland. For with full premeditation and characteristic cynical impudence I praised Bodnar's "deeds" for "the regulation of law" and the observance of the Constitution openly mocking the Head of State. He clearly emphasized that he was drinking it here at the Presidential Palace. It was a deliberate, public humiliation of the president of the Republic – a motion showing contempt for the office and its constitutional meaning. It was so sad to see that.
Worse still, Tusk shoe and arrogance – played in front of the cameras and in front of the full government – did not even meet with the smallest repost from Andrzej Duda. specified inactivity not only encourages Tusk, but confirms his conviction that he can unpunishedly proceed the demolition of the regulation of law.
In this situation, we had nothing else left – and yesterday we announced that Żurek had reported a suspected crime, who openly declared that he would keep criminal lawlessness in the functioning of the Polish prosecutor's office. I can assure him that after the inevitable change of power he will be – together with Tuski and Bodnar – absolutely accounted for what they did to Poland.
