What is the Act of Incident?
A week ago, a draft law concerning the ultimate Court's settlement of matters related to next year's presidential election was received in the Sejm. The proposal assumes that the validity of the elections would be assessed by a composition composed of 3 chambers of SN: Criminal, civilian and Labour.
Before that Simon Holownia, talker of the Sejm and leader of Poland 2050, informed about meetings with presidents of the clubs and parliamentary circles and with president Andrzej Duda, during which he presented the project.
The Polish 2050-TD proposal afraid the debate on the validity of the decision of the State Election Commission of 16 December, which postponed the deliberations on the accounts of the PiS election committee from the parliamentary elections of 2023. The postponement was to apply until the "systemic regulation" by the constitutional authorities of Poland the legal position of the Chamber of Extraordinary Control and Public Affairs of the ultimate Court.
Finally, on Monday, the PCW adopted the study of the Law and Justice on the implementation of the decision of the ultimate Court on 11 December. Ineffective decisions
On TVN24, Vladimir Czarzasty estimated that:
All the decisions that are being made at this minute in the ultimate Court with the engagement of neo-Judges, we as the Left respect as ineffective and with legal defects.
Vladimir Czarzasty, in the “Facts After Facts” programme, objected to the proposal of Marshal Holownia to recognise the results of the presidential election by neo-judges. He criticised the approach in which actions are declared illegal in the morning, and in the evening the same persons act in accordance with the law. He stressed that it was not possible to accept a situation where decisions of the ultimate Court Chamber composed of neo-Judges were rejected erstwhile and otherwise accepted in full. He pointed out that the consequence in the assessment of those performing specified functions was crucial.
The Left is so not to recognise neojudges, and all their decisions are to be regarded as having legal defects and ineffective.
