The request to establish the Constitutional Court already appeared at the time of Poland's regaining independency in 1918, i.e. after 123 years of occupation. Practically the first projects aimed at establishing an institution to control compliance with the Constitution have not contributed to the creation of the Constitutional Tribunal. Many of them, e.g. the proposal of Józef Buzek from 1919, or the endeck priest, MP to the Sejm of the Republic of Poland I and the second word of office of Kazimierz Lutosławski did not lead to the creation of an authority which would have competence to examine the conformity of legal acts with the overriding act. The Constitution of 23 April 1935 did not recognise the request to set up a Constitutional Court, while at the same time reserving that no law passed by the Sejm could be incompatible with the essential act. Thus, it was simply believed in the infallibility of the Sejm. The 1952 Constitution besides did not foresee the establishment of a Constitutional Court, which was due to the political situation in the country. People of pre-war sanitation could not be allowed to rule, that is, full democracy could not be established. At the time, the authorities absolutely did not care about the establishment of an institution in control of Parliament, which in the Constitution held a superior position. Secondly, the mechanics of exercising power in Poland was practically independent of the overarching act. The creation of the Legislative Work Commission on 29 March 1972 (behind Game) was a manifestation of the introduction of the laws. However, it was simply an opinion-making function and the final decisions on this issue were inactive taken by the Sejm. It was only on 29 April 1985 that the Constitutional Court was formally introduced by the Sejm on the initiative of General Wojciech Jaruzelski as an institution in Poland.
