The controversy surrounding the second circular of the presidential election is not silent. More and more politicians and citizens are asking the question: were the elections legal? Minister of Justice and lawyer General Adam Bodnar referred to these doubts in an interview with Money., announcing what opinion he will give to the talker of the Sejm Simon Holown.
Questionable election?
Following the announcement of the authoritative results of the second circular of presidential elections, there were many signals of possible irregularities. In part of the committee there were amazing situations – the candidate who advanced to the second circular did not win almost any fresh votes, and in any cases even little than in the first round. specified results raised suspicions as to the reliability and transparency of the electoral process.
Election protests have not been resolved
Minister Bodnar confirmed that so far all the electoral protests have not been considered and that the full procedure — in his opinion — has not been carried out in a full and orderly manner.
— We surely don't have all the electoral protests under consideration, and this has not been done properly, fully “ Bodnar said. However, he added that considering elections as invalid would be besides far-reaching a step, especially since the Constitution provides a presumption of their validity.
Who should have decided?
According to the Minister of Justice, the substance is not dealt with by the competent authority and the examination of the electoral protests has not been completed. This, as he pointed out, complicates the full situation and requires an appropriate wording of the opinion he plans to present on 1 July.
— I wonder how to put this in the final speech on 1 July “He added in an interview with Money..
Decision in the hands of Holownia
As Bodnar explained, the eventual work for further steps rests with the talker of the Sejm. It will be Simon Holovnia who will gotta make the decision, being aware of “all the constitutional and procedural flaws that have occurred in the process of examining the protests.”
According to Bodnar's opinion, the talker of the Sejm may conclude that there has not been a formal judicial decision on the validity of the elections. specified a legal situation may have serious consequences for the continuation of political developments in the country.
