The day of commemoration of the victims of Katyń Crime is celebrated on 13 April. Although it has been years since this crime, it is inactive an open wound on the Polish heart, which is brushed by the cruel attitude of present-day Russia and, unfortunately, any of our countrymen.

The Institute of National Memory holds that the Katyn crime was an act of genocide. Genocide genocide) is an global law word as defined in the UN General Assembly Resolution of 11 December 1946 and the global Convention on the Prevention and punishment of Genocide Crimes. Genocide are acts specified as murder, a serious assassination of the physical and intellectual constitution of members of the persecuted congregation, deliberate deterioration of the surviving conditions of the collective in order to destruct or limit its number. The intention to destruct full or partial national, ethnic, racial or spiritual groups as specified was considered a condition for genocide. Genocide was considered to be the kind of crime that is not subject to statute of limitations. Not only crimes committed after the 1948 Convention, but besides crimes previously committed, should be prosecuted. It's a fundamental uncovering for the Katyn case. In the light of the UN definition and its interpretation, the Katyn crime should be considered a crime of genocide. It was directed against a large group that was isolated due to nationality and nationality. The intention of the criminals was to completely destruct this group.
Modern Russia, as the legal successor of the russian Union, does not agree to the word Katyn crime as genocide. Russia's General Military Prosecutor's Office declared on 5 March 2006 that the murdered Poles were not victims of Stalinist repression! It has been declared that there is no anticipation of establishing legal qualifications on the basis of which Poles were sentenced to death. Of course! The genocidal act never has "legal qualification". It is itself an act of lawlessness, repression, persecution. Did Germans execution Jews for being Jews request any “legal qualification”?
Russia refuses to recognise the Katyn crime as a mass and genocidal act, both in the light of the definition of genocide and of war crimes or Stalinist repression. The fact that the state's prosecutors with powerful ambitions cannot find any qualifications for Katyń execution should be considered a grim, even ghastly mockery of the victims and provocation towards Poland – says Witold Wasilewski of IPN. Katyń was a politically motivated mass murder. This will not be covered up by the Russian authorities, as the fact about the perpetrators of the massacre failed, despite the ongoing half a century of efforts, to conceal to the authorities of the USSR [...]. The mass nature of the crime is not questionable and the papers drawn up by its perpetrators confirm the national and socio-professional criteria for the selection of victims [...]. Not the actions or even the views held were the origin of their murder, but the membership of the Polish people.
We do not want relations between the Polish and Russian people – who besides suffered from the same oppressors – to lie in the shadows of old russian lies. The deficiency of “qualification” of crime is evasion of work for crimes – Katyń and others, committed in Poles and on representatives of another nationalities on “inhuman land”. This fresh variation of Katyn lies can dig up a gap between Russia and the civilized world.

There are many Russians who realize Polish pain and who do not want modern Russia to be mentally the successor to the criminal communist state. The hope remains that these Russians will have a decisive influence on the form of their country and on relations with their nearest neighbour in the west. specified Russians as Prof. Natalia Lebiedev, as Prof. Sergei Słucz and all those who engaged in the work for the Memorial Association, with the head of the Polish Memorial Commission, Dr. Alexander Gurjanov.

On the question of the Polish journalist, why the russian Politburo decided to commit a crime on prisoners of war, on specified a immense scale, Dr. Gurjanov expressed his opinion that since on 5 March 1940 the fast end of the war with Finland had already been established, russian Politburo felt that there would be no further war in Europe, which means thousands of Polish prisoners would be a problem in the Sovietization of the captured Polish lands, so it is essential to “solve the problem”, according to russian “pragmatic”: there is no man, there is no problem...

In the context of deliberations on the Katyn crime as an act of genocide, public statements in Poland are concerned, questioning the genocide of this crime, They utilized to be speeches by Deputy Marshal of the Polish Sejm [!] Stefan Niesiolowski and president of the Federation of Katyń Families [!] Andrzej Skępski. Ironically, the execution of Katyn Bolesław Skapski was a professional lawyer! The classification of crime as genocide is determined by global law and not by individual views or by an irresponsible politician who is no expert on the matter. Today, it is peculiarly depressing that Andrzej Kunert, the successor of Andrzej Przewoźnik, joined the group who questioned the Katyń crime as genocide as secretary of the Council of Memory of Walk and Martyrdom.

The Katyn crime strikes its scale, eludes all, even the most cynical and ruthless attempts at rationalization," wrote Prof. Wojciech Materski, who is now considered 1 of the most prominent experts in Polish past under russian business in Poland. We already know a lot about the genocide that took place in the spring of 1940, which does not mean that we are able to answer all the questions in this area [...]. We know that it is simply a lie that the fact about the Katyn crime is hidden in secret archives and that another crews in the Kremlin are unaware of it. Based on the documentation from the alleged “package No 1” we know that at least a fewer twelve people from the russian organization alleged first echelon of power were inactive full aware of it. We know that president Mikhail Gorbachev solemnly assures us that he is doing everything he can, many times, to find Katyn documentation. Tens of thousands of photocopies of documentation from the Russian archives we have inactive contain severe shortcomings. specified a lack, especially crucial not only to historians, but besides to the families of victims of Katyn crime, are supposedly destroyed archival folders – 21,857 sets of papers concerning individual prisoners of war and prisoners. The demolition of the files in 1959 suggested to KC's first secretary KPZR Nikita Khrushchev the then KGB chief Alexander Szelepin, but there is no trace of specified destruction. He besides recommended the preservation of the peculiar College protocols, which were liable for the organizational side of the Katyn genocide, and these papers have not yet been made available. The alleged list of Belarusian prisoners held in the alleged territory is missing. Western Belarus, murdered on the basis of the same decision of 5 March; in conditions of preserving at least 2 copies of the alleged Ukrainian list, it is unthinkable that this documentation is not in the post-Soviet archives. We don't know where the bodies of the murdered 7 305 prisoners were buried, though we can guess where it might have happened. Access to the post-Soviet archive resource is systematically narrowed for Polish historians and archivists [...]. The very likely hypothesis of the link between AB's German criminal action and Katyn genocide has not yet been proved [...]. Almost 22 1000 human lives, innocent victims are liable for the decision-makers – Stalin and his closest, panicful surroundings; experts from behind the desk killing – like members of the peculiar Narada; performers – trained murderers and murderers from the accident, NKVD regional workers. Further teams of russian organization and state leaders are liable for concealing the fact about the crime, trying to put it on the Germans, as well as cowardly leaders of the Polish People's Republic, but besides cynical Western politicians, Britons and Americans.

Regardless of the detailed questions, 1 thing is certain: the guilty are known. besides known are those who are their legal successors. Unfortunately, the sense of work they realize differently than we do. Behind Katyn crime there is inactive a shadow of lies and understatements – present further emphasized by the sloppy investigation and the dark mystery of the Smolensk tragedy of April 10, 2010.
